TERMS OF USE AND PROGRAM ENROLLMENT AGREEMENT

Please read this document carefully before enrolling your student in a Lunar Kid Creative program. By submitting an enrollment application, you (the "Parent/Guardian") agree to the terms below on behalf of yourself and your student ("Student"). If you do not agree to these terms, please do not submit an application.

1. ENROLLMENT AND PROGRAM TERMS

1.1 Lunar Kid Creative offers creative arts education programs organized into terms beginning in September and January.

1.2 Submitting an application constitutes a request to enroll and does not guarantee a seat. Enrollment is confirmed only upon acceptance by Lunar Kid Creative and receipt of payment as described below.

1.3 Lunar Kid Creative reserves the right to accept, decline, or discontinue enrollment for any student, including for reasons related to program capacity, fit, or conduct as described in Section 6.

2. PAYMENT TERMS

2.1 Payment in Full Required Before Term Start. Full payment of $800 for the applicable term is due before the term begins. A student's seat is not confirmed, and the student may not begin or continue attending, until payment has been received in full (or, where a payment plan has been separately agreed to in writing, the agreed schedule is current).

2.2 Nonrefundable Payments. All payments are nonrefundable once a term has begun, including in the following circumstances:
   (a) The student voluntarily withdraws or drops out of the program;
   (b) The student stops attending sessions, whether or not formal withdrawal notice is given;
   (c) The student is dismissed from the program by Lunar Kid Creative under Section 6.

2.3 No prorated refunds, credits, or transfers will be issued for partial attendance, missed sessions, or early departure from a term, except at the sole discretion of Lunar Kid Creative.

2.4 Late payments may result in suspension of the student's participation until the account is brought current.

3. COMMUNICATION

3.1 All communication between parents/guardians, students, and Lunar Kid Creative staff or instructors must take place through Lunar Kid Creative's approved communication platforms (e.g., its designated email address, learning portal, or messaging system, as identified in correspondence).

3.2 Parents and students agree not to contact instructors or staff through personal phone numbers, personal email addresses, personal social media accounts, or any other unapproved channel.

3.3 Lunar Kid Creative may update its approved communication platforms from time to time and will notify enrolled families of any changes.

4. REQUIRED MATERIALS

4.1 Students are responsible for providing their own computer (or equivalent internet-enabled device) capable of accessing course materials and any required software or platforms.

4.2 Students are expected to complete assigned reading and related preparatory materials provided by instructors prior to and during each session.

4.3 Lunar Kid Creative is not responsible for providing devices, internet access, or reading materials unless otherwise stated in specific program materials.

5. CONFIDENTIALITY AND NON-DISCLOSURE

5.1 Course materials, curricula, lesson plans, instructional methods, and other materials provided by Lunar Kid Creative ("Program Materials") are proprietary and confidential.

5.2 Parents and students agree not to copy, distribute, publish, sell, or otherwise share Program Materials, or student and instructor work created during the program, with any third party outside the student's immediate family, without Lunar Kid Creative's prior written consent.

5.3 This confidentiality obligation continues after the student's participation in the program ends.

6. ACCEPTABLE CONTENT AND BEHAVIOR

6.1 Students are expected to engage respectfully with instructors and fellow students at all times, whether in live sessions, written communication, submitted work, or any program platform.

6.2 The following are prohibited: harassment, bullying, discrimination, hate speech, threats, or any content that is sexually explicit, violent, illegal, or otherwise inappropriate for a youth creative arts education setting.

6.3 All creative work submitted as part of the program must be the student's own original work (except where an assignment explicitly permits reference material or collaboration) and must comply with the content standards in this section.

6.4 Violation of this section may result in warnings, removal from specific sessions or platforms, or dismissal from the program under Section 7, at Lunar Kid Creative's discretion. No refund will be issued in connection with any such action, per Section 2.2(c).

7. DISMISSAL FROM THE PROGRAM

7.1 Lunar Kid Creative may dismiss a student from a program for reasons including, but not limited to: violation of the acceptable content and behavior standards in Section 6, repeated non-attendance, non-payment, or conduct that disrupts the learning environment for other students.

7.2 Dismissal under this section does not entitle the family to a refund, credit, or transfer of payment, consistent with Section 2.2(c).

8. OWNERSHIP OF WORK AND INTELLECTUAL PROPERTY

8.1 Student-Originated Work. Creative work that is conceived and created by the student — independent of Lunar Kid Creative-provided templates, assets, or studio-directed projects — belongs to the student. Such work is the student's own creation and is protected under applicable copyright law from the moment it is fixed in a tangible form of expression.

8.2 Studio-Originated Work. Program Materials, templates, assignment frameworks, instructional content, and any work product created as part of a studio-directed or studio-branded project (including but not limited to collaborative projects, showcase pieces produced using Lunar Kid Creative's proprietary tools, templates, or characters, and marketing or promotional materials) are and remain the property of Lunar Kid Creative.

8.3 Where a project combines student-originated creative contributions with studio-provided frameworks or assets, ownership of the underlying student contribution remains with the student, while the studio-provided elements (templates, characters, curricular frameworks, and similar assets) remain the property of Lunar Kid Creative. Any specific ownership terms for a given project will be described in that project's assignment materials.

8.4 License to Showcase. By enrolling, parents/guardians grant Lunar Kid Creative a limited, non-exclusive license to display, reproduce, and share student work (with student's first name and age/grade level, but no other identifying information) for educational and promotional purposes, such as showcases, the Lunar Kid Creative website, and social media, unless the parent/guardian opts out in writing at the time of enrollment or at any point thereafter.

9. LIMITATION OF LIABILITY

9.1 Lunar Kid Creative provides its programs on an "as available" basis and makes no warranties regarding specific outcomes, artistic development, or academic results.

9.2 To the maximum extent permitted by law, Lunar Kid Creative's liability for any claim arising from a student's participation in a program is limited to the amount paid for the applicable term.

10. CHANGES TO THESE TERMS

10.1 Lunar Kid Creative may update these Terms of Use from time to time. Continued enrollment or participation in a program after changes are posted constitutes acceptance of the revised terms. Material changes affecting a currently enrolled term will be communicated to enrolled families through an approved communication platform.

11. GOVERNING LAW

11.1 These Terms of Use are governed by the laws of the State of West Virginia, without regard to its conflict-of-laws principles.

12. ACKNOWLEDGMENT

By submitting an application to a Lunar Kid Creative program, the Parent/Guardian acknowledges that they have read, understood, and agree to these Terms of Use on behalf of themselves and their Student.
